Linkbase Terms of Service and End User License Agreement

By downloading, installing, or using Linkbase ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms are the End User License Agreement ("EULA") for the App, whether you got it from the Apple App Store or from Google Play. They form an agreement between you and Kaloyan Bozhkov, an individual developer based in Varna, Bulgaria, who provides Linkbase ("we", "us"). We may update these Terms as described in section 17.
Linkbase is a mobile application that helps you remember the people you meet. It lets you save people, memories, objects, reminders, photos, and videos, and offers AI-powered features such as voice capture, business card scanning, and search. The specific functionality and features available may change from time to time. We reserve the right to modify, suspend, or discontinue any aspect of the App at our sole discretion.
To use certain features of Linkbase, you may need to create an account. You agree to:
Linkbase is free to use on the Free plan. The Free plan includes limits on how many people, memories, and objects you can save, and on how many business cards you can scan per day. Two optional paid plans are available as auto-renewable subscriptions, each billed monthly or yearly:
The current limits and features of each plan are shown in the App before you subscribe. We may change the features included in a plan from time to time.
The price and billing period of each subscription are shown in the App and in the App Store or Google Play before you buy. Prices may vary by country and may include applicable taxes. Payment is charged to your Apple ID account (App Store) or your Google Play account (Google Play) at confirmation of purchase. All purchases are processed by Apple or Google; we never see or store your payment card details.
Your subscription renews automatically at the end of each billing period (monthly or yearly) for the same period and at the then-current price, unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
You can manage your subscription or turn off auto-renew at any time in your store account settings after purchase:
When you cancel, you keep access to your paid plan until the end of the period you have already paid for. Cancelling stops future renewals; it does not refund the current period. Deleting the App or deleting your Linkbase account does not cancel a subscription, so cancel it in your store settings first.
Because payments are processed by Apple or Google, refunds are handled by them under their own refund policies. For App Store purchases, request a refund at reportaproblem.apple.com. For Google Play purchases, see the Google Play refund policy. We cannot issue refunds for store purchases ourselves. Nothing in these Terms limits any refund rights you have under applicable consumer law.
If your subscription is cancelled, expires, or is not renewed (for example because a payment fails), your account returns to the Free plan at the end of the paid period. Nothing you have saved is deleted: your people, memories, objects, reminders, photos, and videos stay in your account and remain viewable. The Free plan limits then apply to anything new you add. If you already have more items than the Free plan allows, you can keep using them, but you cannot add more of that kind until you are back under the limit or subscribe again. If you switch between Basic and Premium, the change is handled by Apple or Google according to their rules for upgrades and downgrades.
We may change subscription prices. Any price change applies from your next renewal, never to a period you have already paid for. You will be notified in advance by Apple or Google as required by their policies, and where the law or store rules require it, you will be asked to accept the new price before it applies. If you do not agree to a price change, you can cancel your subscription before it takes effect.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices that you own or control, as permitted by the usage rules of the App Store or Google Play.
You may not copy, modify, distribute, sell, rent, lease, sublicense, or create derivative works of the App, except as expressly permitted by these Terms or by applicable law. All rights not expressly granted to you are reserved by us.
You agree not to:
The App and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. The App is licensed to you under section 5, not sold.
Any content you submit to the App remains your property, but you grant us a worldwide, royalty-free license to use, modify, and distribute such content in connection with operating the App.
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App. By using Linkbase, you consent to the collection and use of information as described in our Privacy Policy.
You may be able to submit, upload, or share content through the App. You represent and warrant that:
We reserve the right to remove any content that violates these Terms or is otherwise objectionable in our sole discretion.

If you downloaded the App from the Apple App Store, you and we acknowledge that:
If you downloaded the App from Google Play, your use of Google Play is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
AI-powered features (such as voice capture, card scanning, and search) may produce inaccurate or incomplete results. Please review what they save. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Terms affects your statutory rights as a consumer.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless us and our affiliates from any claims, losses, damages, liabilities, and expenses arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.
We may suspend or terminate your access to the App at any time, with or without cause, and without prior notice. Upon termination, your right to use the App and the license in section 5 end immediately, but these Terms will continue to apply to your prior use.
You may stop using the App and delete your account at any time from Settings in the App. What happens to your data when you delete your account is described in our Privacy Policy. Deleting your account does not cancel an App Store or Google Play subscription; see section 4.4.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Varna, Bulgaria. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.
We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date. If a change is material, we will give reasonable notice, for example in the App. Your continued use of the App after the changes take effect means you accept the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior or contemporaneous communications and proposals relating to the App.
